Employers are required to provide to persons entitled to the rights and benefits under USERRA, a notice of the rights, benefits and obligations of such persons and such employers under USERRA.  Employers may provide the notice, "Your Rights Under USERRA," by posting it where employee notices are customarily placed.  However, employers are free to provide the notice to employees in other ways that will minimize costs while ensuring that the full text of the notice is provided (e.g., by handing or mailing out the notice, or distributing the notice via electronic mail).

We understand this is a difficult area for many organizations Human Resources and Legal departments.

In 2009, the Federal government established  under section 5538, Federal agencies must provide a payment—hereafter referred to as a “reservist differential”—equal to the amount by which an employee’s projected civilian “basic pay” for a covered pay period exceeds the employee’s actual military “pay and allowances” allocable to that pay period. . For a complete summary of the law, please click here. 

The link above titled "Military Leave of Absence Guide and Sample," provides a document with guidelines for creating or updating your Military Leave policy. It has information from the Veteran's Administration and a sample policy from a Fortune 100 corporation. Whether or not you can go above the Uniform Services Employment and Reemployment Rights Act requirements, this offers you to get you where you want to be. Of course, our volunteers can help you craft the military leave policy that works for you.

We collect information about laws and government programs created  to  reimburse you for hiring and continuing the careers of local and national guard, military reserve, and veterans. This is summarized in our "Tax Incentives for hiring Veterans." and this also relates to Guard and Reserve members who are Veterans (determining Veteran Status).   The links in this section will help you navigate and understand the reimbursements your organization is due for doing the right thing and supporting our national defense. This section is continually updates per changes in California and National law affecting employers of civilian warriors. 

We are carefully following any congressional or other government activity that may benefit organizations that employ or support guard and reserve members, their families, and other veterans. Of note is the “Reserve Employers Comprehensive Relief and Uniform Incentives on Taxes Act of 2021” or as the “RECRUIT Act of 2021” was introduced in the House of Representatives in March of 2021. If you have an essential employee who is a military reservist called to active duty, SBA provides loans to help eligible small businesses with operating expenses.

 

Eligibility

  • The maximum Military Reservist Economic Injury Disaster loan (MREIDL) loan amount is $2 million.
  • The amount of each loan is limited to the actual economic injury as calculated by SBA, business interruption insurance and whether the business and/or its owners have sufficient funds to operate.
  • If your business is a major source of employment, SBA has authority to waive the $2 million statutory limit.
  • Businesses with the financial capacity to fund their own recovery are not eligible for MREIDL assistance. Federal law requires SBA to first determine whether the credit necessary to accomplish full recovery is available from non-government sources without creating an undue financial hardship. 
  • The filing period begins on the date the essential employee receives a notice of expected call-up and ends one year after the essential employee is discharged or released from active duty.


Use of proceeds

You can use proceeds for ordinary and necessary operating expenses

You may not use proceeds:

  • To cover lost income or lost profits
  • In lieu of regular commercial debt, to refinance long-term debt or to expand the business

The HIRE Vets Medallion Award is the only federal-level veterans’ employment award that recognizes a company or organization’s commitment to veteran hiring, retention, and professional development.

SUMMARY:

VETS published a proposed rule implementing the Honoring Investments in Recruiting and Employing (HIRE) American Military Veterans Act of 2017 (HIRE Vets Act or Act). The HIRE Vets Act requires the Department of Labor (DOL or Department) to establish by rule a HIRE Vets Medallion Program (Medallion Program) and annually solicit and accept voluntary information from employers for consideration of employers to receive a HIRE Vets Medallion Award (the award). Under the Program, VETS will review applications and notify recipients of their awards, and announce their names at a time that coincides with Veterans Day. This final rule sets out the criteria for the different categories and levels of HIRE Vets Medallion Awards, the award application process, and the award fees. VETS invited written comments on the proposed rule, and any specific issues related to the proposal, from members of the public.

 Secretary of Defense Lloyd J. Austin III  issued a memorandum in August 2021 directing mandatory COVID-19 vaccinations for service members, a Pentagon official said today. John F.  As changes due to coronavirus disease 2019 continue, reservists and members of the National Guard may wonder about impacts. 

The questions and answers in the provided link (from Military One Source) address ways that sheltering-in-place orders, self-monitoring and other changes may affect your guard and reserve employee's training, duty, pay and benefits. Please engage with your military employee and assure they know of these resources. 

EXAMPLE: We encourage you to discuss this with your military employee:  The Consolidated Appropriations Act, 2021 extended the period for collecting deferred 2020 Social Security taxes. The collection will now span from Jan. 1-Dec. 31, 2021. This spreads the repayment across 12 months of pay instead of four (Jan. 1-April 30, 2021), as previously ruled.

This is often done in a breakfast or lunch seating,  and the attending boss will often be presented with a Department of Defense award based on their guard and reservist's nomination.

The Statement of Support Program is the cornerstone of the Department of Defense program Employer Support of the Guard and Reserve’s effort to gain and maintain employer support for the Guard and Reserve. Supportive employers are critical to maintaining the strength and readiness of the Nation’s Guard and Reserve units.


Since its inception, hundreds of thousands of employers have signed Statements of Support, pledging their support to Guard and Reserve employees.

Employers signing a statement of support pledge that:

  • We fully recognize, honor, and comply with the Uniformed Services Employment and Reemployment Rights Act.
  • We will provide our managers and supervisors with the tools they need to effectively manage employees who serve in the Guard and Reserve.
  • We appreciate the values, leadership, and unique skills Service members bring to the workforce and will encourage opportunities to hire Guardsmen, Reservists, and Veterans.
  • We will continually recognize and support our country’s Service members and their families, in peace, in crises, and in war.
